2009 Election Timeline and Eligibility Requirements

Dear Local 1588 Members:

We have been appointed by the Local 1588 Executive Board to be the Election Committee responsible for overseeing the conduct of the 2009 election for Officers and Trustees. Below is important information about the election, including dates and deadlines and eligibility requirements to run, nominate, and vote. The information has also been mailed to every member.

We are strongly committed to making sure that the entire election process runs smoothly and is fair and transparent. If you have any questions about the election, please do not hesitate to contact one of us through the Local or on the job.

Notice of Election Schedule and Timeline

Timeline
Wednesday, October 28: Deadline for submitting statement of intent to run.
Members who are interested in running for office must submit a written statement of intent to run to the Local by 12:00 PM, Wednesday, October 28. The Administrator will review each submission and rule whether the member is eligible to run based on the provisions of the Consent Decree of 1992 and the District Court Order of 2003.

Monday, November 16: Nominating Meeting, 5:30 PM Bayonne Jewish Center, 1050 Kennedy Blvd (b/w 44th and 45th Streets) Bayonne, NJ

Thursday, November 19: Deadline for submitting request for absentee ballot.

Thursday, December 3: Election, 7:00 am to 7:00 pm, RV Camper parked near the intersection of Port Jersey Blvd and Colony Road.











Positions to be Voted on in December 3, 2009 Election

Secretary-Treasurer (at large)
Recording Secretary (at large)
Vice President, Deep Sea Division (Deep Sea members only)
Vice President, Warehouse Division (Warehouse members only)

Trustees
Three (3) positions, all at large.

Eligibility Requirements to Run for Office

You may run in the December 3 election if:

1. You have been a member in good standing for two years on the date of the nominating meeting.
2. You submit a written statement of intent to run for office to the Administrator by Wednesday, October 28 and the Administrator determines that you can run under the terms of the Consent Decree of 1992 and the District Court Order of 2003 requiring that: “All candidates for elective office at Local 1588 must be free from corruption and the influence of any criminal group. The Administrator will review the candidacy of any individual seeking union office. In the event the Administrator discovers information indicating that any potential candidate has (1) violated the injunctive provisions of the Consent Order; [or has] (2) furthered the direct or indirect influence of organized crime or the threat of such influence now or in the future, the Administrator may disallow the particular nomination or election of the individual.”

All members who meet the above requirements may run for the at-large positions of President, Secretary-Treasurer, or Recording Secretary.

Only members of the Deep Sea Division (Global, Ceres, Ports America Deep Sea list, Maher, and Sims Metal) who meet the above requirements are eligible to run for the position of Vice President, Deep Sea Division.

Only members of the Warehouse Division (BMW, Ports America Warehouse) who meet the above requirements are eligible to run for the position of Vice President, Warehouse Division.

Eligibility Requirements to Nominate or Second
You may nominate or second at the November 16 nominating meeting if you are a member in good standing of Local 1588 at the time of the meeting.

Eligibility Requirements to Vote
You may vote in the December 3 election if you are a member in good standing of Local 1588 by 12:00 PM Wednesday, December 2.

Absentee Balloting
Absentee balloting will be available to those who have a legitimate, scheduled absence on the day of the voting. Your request to vote by absentee ballot, and proof of the legitimacy of the absence, must be submitted to the Local by Thursday, November 19, 12:00 PM. Absentee balloting will take place in person at the Local at two designated times (to be announced) so that all candidates will have an opportunity to have an observer present during the casting of the absentee ballots.
